2. Permitted Uses & Content ID Claim Release
Background synchronization
The Track must serve as background audio accompanying original primary video content created by Licensee (e.g. vlogs, tutorials, gameplay, reviews, presentations, narrative videos, travel clips, cooking, or fitness content). Videos in which the music or the ambience is itself the point are outside this licence — see Section 4.1 for the formats this excludes.
Allowed audio edits
Licensee is permitted to make standard editing adjustments to fit the background of the video, including:
(a) Trimming, cutting, and fading in/out.
(b) Looping or repeating the Track within the runtime of the video.
(c) Ordinary equalisation (EQ) or compression.
(d) Audio ducking under speech or narration.
(e) Mixing the Track underneath footage, narration, sound effects, or other audio.
Monetization scope & limits
Once the Content ID Claim is released ("whitelisting"), Licensee may monetize the video on YouTube via standard YouTube Partner Program features, channel memberships, and integrated creator sponsorships (i.e. a sponsored mention or segment inside your own video content).
Monetization is not guaranteed
Monetization is ultimately subject to YouTube's sole discretion and policies. Other rights holders may hold independent claims on other elements of the same video. Audio Sanctum does not guarantee or warrant that a video will be or remain monetized.
Perpetual scope & subscription expiry
Once successfully whitelisted for a specific YouTube video, this licence remains in effect for that specific video indefinitely — even after a Subscription plan ends or is cancelled. Ending a Subscription stops future whitelisting releases but does not revoke previously whitelisted videos. "Indefinitely" is subject to Licensee keeping to this Agreement: a material breach of Section 4, or removal of the Credit Text required by Section 5, may void this licence, and Section 6 sets out the Content ID re-claim and takedown that follow.
Re-uploads & replacement videos
If Licensee deletes the licensed video and uploads it again, the re-upload is a new video that this licence does not automatically cover. However, upon written request to contact@audiosanctum.com, once the original video has been taken down, and on reasonable proof that the replacement upload contains substantially the same content, Licensor will re-attach this licence to that replacement upload at no extra charge. The licence keeps its number and its original issue date, and this certificate is reissued naming the replacement video. Where a separate certificate was issued for that same replacement video, it shall be rendered null and void upon re-attachment, and only the updated reissued certificate shall remain in effect.
3.1 Whitelisting & Claim Release Process
(a) Submission & detection mechanics
To release a Content ID claim, Licensee must connect the video through Licensor's designated
Claims Page on the Audio Sanctum platform.
Free accounts
Licensee submits the direct YouTube video URL on the
Claims Page. The video is then marked "Under Review".
Subscription accounts
Licensee connects their YouTube channel on the
Claims Page. Content ID claims on that channel are detected automatically, without submitting individual video URLs.
(b) Review status & auto-resolve
On submission or automatic detection the claim enters review. An automated auto-resolve check or a manual review verifies compliance, including the presence of the Credit Text required by Section 5.
(i) This licence is strictly conditional on that verification succeeding. The Track is not licensed, and no claim release is granted, until every issue raised on the
Claims Page has been resolved by Licensee.
(ii) Licensee receives status updates and any required corrective action on the
Claims Page and by email.
(c) Review turnaround
Licensor will use commercially reasonable efforts to complete the review of a submitted or detected claim within forty-eight (48) hours. At the end of that review the
Claims Page shows one of two things: the correction required from Licensee, or that the claim is ready to be released.
(d) Release is immediate, and its timing is Licensee's
Releasing a claim whitelists the video with our licensing Partner, and that whitelisting is the clearance itself — there is no further step and no further waiting. Where Licensee has auto-resolve switched on, it happens the moment the claim passes review. Otherwise it happens when Licensee releases the claim on the
Claims Page, and when that occurs is Licensee's own choice; no period is promised for a claim that is waiting on Licensee to act.
(e) Technical delays
Licensee acknowledges that review and release depend on third-party platform infrastructure, our licensing Partner's processing pipeline, and automated synchronization between them. Delays caused by third-party technical issues, platform API outages, maintenance, or a manual review on the Partner's side do not constitute a material breach of this Agreement, and Licensor is not liable for them — subject to Sections 14.6 and 20 of the
Terms of Use, which govern that exclusion and preserve liability for intent and gross negligence and the mandatory rights of consumers.
3.2 Pre-Release Deficiencies & Service Pause
(a) Pre-release remediation
If, at the time of review, the required conditions — such as the Credit Text under Section 5 — are not met, the claim is not released and the video is not yet whitelisted. Licensee must cure every flagged deficiency on the
Claims Page; once a re-check confirms the conditions are met, the claim is released and whitelisting protection begins. No Content ID re-claim or takedown arises from this pre-release state — that consequence applies only to the removal of Credit Text from an already-cleared video under (b).
(b) Post-clearance alteration
If Licensee alters, removes or deletes the mandatory Credit Text from the public description of a cleared video:
(i) Licensor may immediately pause licensing services, whitelisting protection and active claim releases for the affected video and the associated account.
(ii) Licensor will notify Licensee by email or on the
Claims Page, identifying the missing Credit Text.
(iii) Services stay paused until Licensee restores the Credit Text on YouTube and updates the
Claims Page.
(iv) Where the affected whitelisting relies on a Subscription, billing follows this pause: the paid Subscription period runs to its scheduled end (no refund, and it is not cut short); no renewal payment is charged while the Account remains paused; and if the Subscription period expires during a pause, a new Subscription period shall commence and be billed only after the required Credit Text is fully restored and verified. Upon verification, the purchase restrictions are lifted and Licensee shall elect one of the following to resume Subscription Whitelisting: (a) reactivate under the same configuration (billed as of the date of election); (b) select a different plan; or (c) cancel the Subscription. Licensor will send electronic reminders while such election remains outstanding. If Licensee makes no election within thirty (30) days of the Credit Text being restored, the lapsed Subscription is cancelled automatically and the Account reverts to the free tier. Videos whitelisted before cancellation, carrying valid Credit Text, remain whitelisted under the Perpetual scope & subscription expiry clause above.
(v) The pause has no fixed time limit and lasts until the Credit Text is restored. But if it remains missing 30 days after the pause began, or if the Subscription supporting this licence ends or is downgraded to the free tier while the credit is missing, the video no longer holds a valid licence: this is a material breach, and Licensor may instruct our Partner to re-assert a Content ID claim or submit a YouTube copyright takedown request under Section 6.
(c) No other cure
No other post-clearance modification or content error is recognised as a ground for exception or cure. Any reuse, re-upload or transfer to another platform outside the scope of Section 3 remains a breach of Section 4 and voids this licence.
3.3 Permitted Self-Promotion & Paid YouTube Promotion
(a) Channel trailers & own merchandise
Licensee may synchronize the Track in a YouTube channel trailer, or in a video promoting Licensee's own channel, services or physical merchandise, provided the video complies with the rest of this Agreement — including one (1) video per Licence ID.
(b) YouTube paid promotion
Licensee may use YouTube's own paid promotion features — the "Promote" button, or Google Ads for Video — to boost or sponsor the licensed video, provided the video is not itself a third-party commercial advertisement of the kind prohibited by Section 4(f).
3. Prohibited Uses & General Restrictions
Licensee SHALL NOT:
(a) Standalone distribution & resale
Re-upload, redistribute, sub-licence, resell, lease, share, or make available the sound recording (in whole or in part, including any standalone audio file) anywhere outside the one (1) licensed YouTube video.
(b) False ownership claims
Claim, state, or imply, explicitly or implicitly, ownership of the Track or any underlying copyright, master rights, or publishing rights.
(c) Rights system registration
Register, submit, or upload the Track (in whole, in part, or embedded within a new work) to YouTube Content ID, any automatic audio fingerprinting system, collecting society, performance rights organization (PRO), digital distributor, or royalty management platform.
(d) Misleading metadata & labeling
Label, tag, describe, or categorize the Track or video as "royalty-free", "copyright-free", "Creative Commons", or "public domain" in any title, description, tags, keywords, metadata field, platform, or social media post.
(e) AI & machine learning exploitation
Use the Track for any artificial intelligence or machine learning purpose, including training, fine-tuning, dataset creation, algorithmic audio generation, voice cloning, fingerprinting, or model input.
(f) Off-platform & unlicensed commercial use
Synchronize or broadcast the Track outside YouTube (e.g. TV, cinema, games, podcasts outside YouTube, standalone Instagram/TikTok posts) or in a video produced as an advertisement or commercial promo for a third party, without a separate direct licence. Promoting Licensee's own channel, services or merchandise, and paying YouTube to boost the licensed video, are permitted — see Section 3.3.
(g) Prohibited audio derivatives
Extract stems, sample, isolate vocals or instruments, pitch/tempo-shift to create a new musical work, re-arrange, remix, sing/rap over, or build mashups, medleys, or continuous mixes. (Allowed editing is strictly limited to Section 3.)
(h) Credit Text alteration or removal
Remove, alter, shorten, obscure, hide, or delete the mandatory Credit Text specified in Section 5 from the public text description of the licensed video for as long as the video uses the Track.
4.1 Prohibited music-focused and ambient-focused formats
Even if audio editing complies with Section 3, the Track shall not be used where the musical or ambient experience is the primary draw of the video. Prohibited formats include:
Music & ambient releases
Music videos, visualizers, lyric videos, static image uploads, audio-only uploads, or standalone re-uploads.
Extended / looped formats
"1 Hour of", "10 Hours of", continuous loop videos, or seamless repetition videos where the video exists primarily to deliver extended audio.
Mood & relaxation content
Meditation, sleep, study, focus, "cozy ambience", ASMR, or soundscape videos.
Compilations & mixes
Playlists, medleys, continuous DJ mixes, or compilations featuring the Track.
Ambient & scenic backdrops
Ambient scenes, nature scenes, fireplace, aquarium, rain, café or train-window videos, screensaver and wallpaper loops, and similar footage that exists to carry a soundtrack.
These formats are not forbidden outright — they are simply not covered by this licence. They are available only under a YouTube Music Creator partnership with Audio Sanctum, which is a separate agreement. Ask at contact@audiosanctum.com before publishing one.
5. Reservation of Rights, Enforcement, and Legal Framework
Ownership
Audio Sanctum retains full, exclusive ownership, title, copyright, and Content ID rights to the Track. This licence is a limited authorization of synchronization, not a transfer of intellectual property.
Enforcement
If Licensee materially breaches this Agreement (e.g. violating Section 4 or removing Credit Text), Audio Sanctum reserves the right to issue a Content ID Re-Claim or initiate a YouTube Copyright Takedown Notice through our licensing Partner (Songmate/EpicElite) in accordance with our
Terms of Use.
Consumer rights & statutory provisions
Nothing in this licence affects statutory consumer rights under applicable law. Right of withdrawal is governed by Section 12 of our
Terms of Use; cancellation by Section 9 and refunds by Section 13.
Relationship to the Terms of Use
This Agreement and the Audio Sanctum
Terms of Use are read together. Pursuant to Section 24.7 of the
Terms of Use, if a direct conflict arises on the specific scope of this licence, this Agreement prevails for this Licence ID. For dispute resolution and authoritative language, refer to the
Terms of Use.
6.1 Governing Law & Jurisdiction
This Agreement, its interpretation, and any dispute or claim arising out of or in connection with it — including non-contractual disputes and claims — are governed exclusively by the laws of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
Where Licensee is a business or professional, this Agreement is governed exclusively by the laws of Austria (excluding its conflict-of-law principles and the UN Convention on Contracts for the International Sale of Goods). The exclusive place of jurisdiction for all disputes arising out of or in connection with this Agreement is the court with subject-matter competence in Vienna, Austria.
Where Licensee is a consumer, this choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence. Jurisdiction follows the applicable mandatory statutory rules, and Licensor may bring legal proceedings against a consumer only in the competent courts of the consumer's statutory forum.
